Aircraft repossessing is one of the highlights and specialties of our aviation practice. Over the last decade we have assisted a large number of aircraft leasing companies repossess multiple aircraft from India. The support which we provide for aircraft repossession is varied and cuts across different spheres of law.

Assisting in refinancing transactions

A number of our aircraft leasing company clients are constantly re-financing their existing fleets. At times these refinancing transactions include an aircraft which are on lease to Indian lessees. Our firm assists such lessors to make any and all regulatory filings to ensure that the refinancing transactions are closed promptly and on time.

Asset Backed Securitization Support

We have provided support to leasing companies when they enter into ABS transactions which affect aircraft which are based in India.

Aircraft Lease Novation’s and Amendments

We provide assistance to a large number of aircraft leasing companies when aircraft are traded hence requiring a detailed novation and amendment process. We have assisted our clients in scrutinizing the transaction documents, carrying our detailed lien searches, issuing necessary legal opinions and performing any and all regulatory actions that may be required in furtherance of the transactions.

Engine Financing Transactions

We have assisted some of the largest names in the industry in relation to financing of aircraft engines. The financing of aircraft engines is especially challenging in India considering that the Cape Town Convention Regulations in India currently do not recognize engines but only airframes.

Aircraft Purchase Transactions

We have, over the last several years assisted one of the largest aircraft manufacturers based in the United States of America during their sale transactions to airlines in India. Our other experience also includes advising on PDP financing, etc.

Sale and Purchase of Corporate Jets

We have provided support to private entities operating under non-scheduled operators permits and private operating permits in the purchase and / or sale of aircraft.

Support to Airlines

We have provided support to international airlines in India and regularly advise them on employment issues, operational issues, etc.

Regulatory Matters

We assist clients on obtaining regulatory approvals which include approvals for external financing issued by the Reserve Bank of India and operating authorizations as issued by the Directorate General of Civil Aviation. We also provide assistance in obtaining security clearances from the Bureau of Civil Aviation Security.

Litigation

We provide litigation services in relation to aircraft repossession and challenging local authorities in the export of aircraft from India. We have represented several airlines challenging various notifications of law.
